Terms & Conditions

1. Definitions

1.1. "Customer" refers to the individual or entity (or any authorized representative thereof) listed on any quotation, work order, sales agreement, contract for sale, or similar document provided by The Home Filtration Company Pty Ltd (hereafter referred to as "the Company").

1.2. "Company" refers to The Home Filtration Company Pty Ltd.

1.3. "Goods" encompass all products supplied by the Company to the Customer, including associated services where applicable, as described in any sales agreement, invoice, quotation, or other documentation provided by the Company.

1.4. "Services" refers to all services provided by the Company in connection with the supply or installation of the Goods.

1.5. "Price" means the amount payable for the Goods, as agreed between the Customer and the Company in accordance with Clause 4 of these terms.

2. Compliance with Laws (Competition and Consumer Act 2010 & Fair Trading Acts)

2.1. These terms comply with the Competition and Consumer Act 2010 (CCA), the NSW Fair Trading Act, and any other applicable laws within Australia. Nothing in these terms seeks to exclude, restrict, or modify rights available to the Customer under these Acts unless legally permitted.

2.2. The Customer acknowledges that Australian Consumer Law provides guarantees that cannot be excluded, including guarantees related to the acceptable quality of Goods and Services.

4. Price and Payment

4.1. Price Determination is subject to clause 4.2. 
The Price will be determined as follows:
(a) As indicated on the invoice provided to the Customer;
(b) As per the Company's current pricing at the date of delivery; or
(c) As quoted, provided acceptance occurs within 30 days.

4.2. Price Adjustments
The Company reserves the right to adjust the Price under the following circumstances:
(a) If there are changes to the original quotation, including but not limited to variations in quantities, specifications, or additional requests made by the Customer;
(b) If external factors impact costs, such as changes in taxes, duties (including GST, excise, or stamp duties), exchange rate fluctuations, insurance, or freight charges;
(c) If unforeseen issues arise during installation, such as access challenges, unsafe conditions, structural issues, or other site-specific obstacles requiring additional work or materials;
(d) If modifications or alterations are requested after acceptance of the quotation;
(e) If regulatory changes impose additional compliance requirements that increase costs.

4.3. Deposit
The Company may require a deposit, the amount of which will be specified prior to order confirmation.

4.4. Payment Terms
Payments must be made as specified on the invoice or within seven (7) days if no terms are provided. Accepted payment methods include cash, bank transfer, cheque, or credit card. Credit card payments may incur additional fees.

4.5. GST and Taxes
The Price is exclusive of GST and other applicable taxes unless explicitly stated otherwise.
 

5. Delivery of Goods

5.1. Delivery is deemed complete when:
(a) The Customer collects the Goods from the Company's premises;
(b) The Goods are delivered to the Customer's nominated address; or
(c) Installation of the Goods is completed.
 

5.2. Delivery costs may be additional unless specified otherwise.

5.3. The Company is not liable for delays caused by unforeseen events, including but not limited to adverse weather, supply chain disruptions, or regulatory delays.

6. Customer Acknowledgments

6.1. The Customer acknowledges that the Company provides general information about product performance but does not guarantee specific outcomes unless confirmed in writing.

6.2. Environmental and external factors, including municipal water quality and third-party actions, may impact the Goods’ performance.

6.3. The Customer is responsible for ensuring water entering the system is potable and free from contaminants.

7. Installation

7.1. The Customer must ensure the installation site is prepared, compliant, and safe for the Company’s personnel. Any remedial work required to make the site compliant will be treated as a variation and charged accordingly.

7.2. The Company may delay installation if site conditions are deemed unsafe, with associated costs borne by the Customer.

Any disputes will be governed by the laws of New South Wales, and parties agree to submit to the jurisdiction of NSW courts.

8. Title and Risk

8.1. Risk in the Goods passes to the Customer upon delivery or completion of installation.

8.2. Ownership of the Goods remains with the Company until full payment has been received.

9. Warranty

9.1. Limited Warranty
The Home Filtration Company Pty Ltd ("the Company") provides a comprehensive warranty for its products and services to ensure quality and customer satisfaction. This warranty applies only to the original purchaser or customer of the Company and is subject to the terms and conditions outlined herein.
 

(a) Warranty Period
The warranty period includes:

A 2-year manufacturer’s warranty for all products; and
A plumbing warranty of up to 7 years, depending on the requirements of the applicable state or territory. (Excludes Filter cartridges)

(b) Warranty Coverage
The warranty covers defects in material, workmanship, factory handling, preparation, and installation, and includes but is not limited to the following components and services:

-Stainless steel framework
-Stainless steel covers
-PVC housings
-Filters
-Installation and works performed by certified plumbers of The Home Filtration Company Pty Ltd.

(c) Warranty Exclusions
The warranty does not cover:

-Installation or works performed by non-certified or external plumbers (i.e., plumbers not certified by the Company), including plumbing parts, services, and advice provided by external plumbers.
-Any system, including the 3-stage home filtration system, that has been manipulated, changed, altered, or otherwise modified such that it no longer complies with the Company’s original configuration.
-Damage or defects caused by improper installation, use, or maintenance not in compliance with the Company’s instructions.

9.2. Disclaimer
This Limited Warranty applies only if the system is installed, used, and maintained in full compliance with the instructions provided by the Company and installed by a certified plumber approved by the Company. Failure to adhere to these requirements voids the warranty. 
 

9.3. Customer Obligations
To make a claim under this warranty, the Customer must:
(a) Notify the Company in writing of any defect within the applicable warranty period.
(b) Provide proof of purchase and evidence of the defect, including photographs or a detailed description, if requested.
(c) Allow the Company reasonable access to inspect the Goods and perform repairs or replacements, as necessary.
 

9.4. Statutory Rights
This warranty is provided in addition to any rights or remedies the Customer may have under Australian Consumer Law. Goods supplied by the Company come with guarantees that cannot be excluded under the Australian Consumer Law. Customers are entitled to a replacement or refund for major failures and compensation for other reasonably foreseeable loss or damage.
 

9.5. Warranty Service
If a valid claim is made within the warranty period, the Company will, at its sole discretion, repair or replace the defective Goods or components, or provide a refund for the defective portion of the Goods or Services.
 

9.6. Limitations on Liability
To the fullest extent permitted by law, the Company’s liability under this warranty is limited to the cost of repair or replacement of the defective Goods and does not extend to indirect, incidental, or consequential damages.

10. Refund Policy

10.1. Refunds, repairs, or replacements will be provided in accordance with Australian Consumer Law.
10.2. Refunds for change of mind are not provided.

11. Limited Liability

11.1. To the fullest extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages arising from the use of its Goods or Services.

12. Force Majeure

12.1. The Company is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, or regulatory changes.
